Denton v. City Council of the City of Hopewell

Janice Denton is suing the Hopewell City Council for violation of FOIA’s meeting provisions. The council voted 5-2 in on Jan. 6, 2015, to go into closed session, citing the personnel exemption, for the purpose of selecting who would be the next mayor and vice mayor. Two council members objected to the closed session and read their objections into the meeting minutes.

Denton filed suit in general district court and lost. She then filed suit in Hopewell Circuit Court with Andrew Bodoh of Richmond as her attorney.

The packet submitted for summary judgment at the Aug. 18, 2015, hearing is below, as are the city’s brief in opposition, Denton’s response to that brief, and the transcript of the Aug. 18 hearing.
