The Justice Department’s Office of Legal Counsel issued a 52-page memo declaring the Presidential Records Act unconstitutional, arguing it exceeds Congress’s powers and infringes on executive independence. Authored by Assistant Attorney General T. Elliot Gaiser, the opinion states the law serves no valid legislative purpose and likens congressional seizure of presidential records to taking Supreme Court justices’ papers. This marks the first time a president has rejected the law on separation of powers grounds, breaking with precedent since its 1978 enactment.
